How to avoid the career-ending traps of AI hallucinations and judicial hypocrisy in the modern legal landscape.
In the first quarter of 2026 alone, over $145,000 in sanction amounts were issued against lawyers for misuse of AI in court cases. Lawyers have been called before State Bars and suspended for AI misuse.
This ethics credit program looks at AI and the ethics issues for lawyers, focusing on risks and best practices given the issues surrounding AI engines and information disclosure into AI systems, emerging discovery issues about client AI queries that may be discoverable, as well as errors and hallucinations that plague both lawyers and courts.
It will explore the latest sample state standards emerging to govern the use of AI as it relates to the three core ethics-governed duties at issue, Candor, Confidentiality, and Competency, as well as the risks to lawyers, including cases of fines, bar suspensions, and discipline from erroneous use of AI.
But we also pause to look at judicial use of AI where actual case orders have been issued with fake cases and quotes due to judicial misuse of AI, and we explore the emerging double standard on ethics when courts go rogue compared to lawyers in terms of punishment disparities between the bench and bar. Is what's good for the goose good for the gander?
