Presenting Evidence in the Digital Era: Modern Strategies

The CBA is a professional organization that provides educational and networking opportunities for lawyers. Representing more than 36,000 lawyers, judges, notaries, law teachers, and law students from across Canada, the CBA is committed to enhancing the professional and commercial interests of a diverse membership and to protecting the independence of the judiciary and the Bar.

I work with law firm or corporate clients who need to assess a lot of digital data for litigation and regulatory matters. To find key evidence on an expedited basis, we leverage both state-of-the-art AI technology and leading review management strategy. Prior to joining Deloitte, I practiced as a digital evidence and eDiscovery lawyer at a leading Canadian law firm, as well as a controls engineer in automotive manufacturing. I am an active contributor to Sedona Canada’s AI and eDiscovery education initiatives and vice-chair of the Ontario Digital Evidence and eDiscovery working group.

Rebecca has a wide-ranging litigation practice, including commercial and corporate law, administrative and regulatory law, and criminal law. She has appeared as counsel before all levels of courts of British Columbia, the Federal Court of Appeal, and various administrative tribunals, including the Law Society of BC Tribunal, the Forest Appeals Commission, and the BC Farm Industry Review Board. Rebecca has been recognized by her peers in The Best Lawyers® in Canada for her work in Corporate and Commercial Litigation and Administrative and Public Law, as a Future Star by Benchmark Canada, and as a “Rising Star” in dispute resolution by The Legal 500. Rebecca has experience advising clients on complex matters that involve navigating the intersections of criminal, regulatory, civil, and administrative law. She has conducted civil and criminal trials and administrative hearings on behalf of both private and public entities. She has also been engaged as an investigator into matters of professional conduct. Rebecca is a graduate of the four-year Juris Doctor/Master of Arts (International Affairs) program at the University of Ottawa and Carleton University. After graduating in 2012, Rebecca interned with the Pre-Trial Division of the International Criminal Court in The Hague. Rebecca clerked for the Supreme Court of British Columbia in 2012–2013 for six judges, and then joined Hunter Litigation Chambers in 2013. Rebecca has volunteered for Access Pro Bono and has acted pro bono on various matters over the years. Rebecca has co-authored the "Civil Procedure – Court Rules" chapter in the Continuing Legal Education Society of BC’s Annual Review of Law & Practice text since 2017 and has presented to lawyers on various topics of advocacy. She is a member of the Canadian Bar Association.

Clients turn to Moya for her experience in advising on burgeoning disputes early, and in real time, to provide a litigation lens to corporate activities as disputes crystallize, particularly in the context of large privately held businesses. Moya also has experience with cases involving allegations of breach of fiduciary, breaches of non-competition covenants, misuse of confidential information claims and theft of corporate opportunities. Moya’s work in infrastructure and construction litigation includes design/construction deficiencies, bid/tender issues, delay and loss of productivity claims, and fairness and procurement processes. Clients in the infrastructure and construction industries will benefit from her ability to provide real-time strategic litigation risk management advice. Moya has both a trial and appellate practice. She has appeared before all levels of Court, including the Supreme Court of Canada, and has been counsel in private arbitrations involving issues of professional negligence and commercial disputes.

Robert’s litigation practice focuses on commercial and civil litigation, as well as media law. Robert also has experience utilizing alternative dispute resolution methods, including judicially assisted mediations. Robert’s insurance law experience includes first-party, third-party, and subrogated claims. Robert also practises in the area of administrative and regulatory law, with a focus on matters pertaining to professional discipline. He acts as a prosecutor for professional regulatory bodies in relation to matters involving professional misconduct and also acts as counsel to hearing panels where he provides guidance on process and procedure. Robert has successfully appeared before the Provincial Court of Manitoba, the Manitoba Court of King’s Bench, and the Manitoba Court of Appeal, in addition to being involved in matters appearing before private mediators and administrative tribunals.
